TERMS AND CONDITIONS (TRADE):

 

Please read the following Terms & Conditions for Shearer Candles. By reading this you accept all Terms & Conditions stated here. If you do not agree to these terms, please do not use this website.

We reserve the right to update and amend these Terms & Conditions at any time. When changes are made we will reflect this on the site and endeavour to inform you. It is your responsibility to read the Terms & Conditions regularly.

 

PRIVACY AND DATA PROTECTION

 

Shearer Candles respects your privacy and will treat all information confidentially.

We require certain information in order to conduct our business together. The data collected can include: Name, Address, Telephone number, Email address, Password and Payment details. We may also ask you general questions in order to improve our service to you. Other than our advisors and finance providers we will not share your information with third parties. 

We will use your information for the following:

  • To conduct business between ourselves
  • To contact you about Shearer Candles' promotions and services
  • To maintain and improve the content of our marketing and publications
  • Complaint handling and other enquiries
If you which for more information about the data we hold, or you wish to have your data removed from our records, please contact us.


INTELLECTUAL PROPERTY

 

The content included in Shearer Candles' publications  (logos, trademarks, pictures, text and designs) is protected by copyright and other intellectual property rights. You do not have permission to copy, modify, distribute or reproduce any content therefrom.

 

ORDERS

 

You must provide us with accurate, complete information and it is your responsibility to inform us of any changes to that information (including in particular, your e-mail address) either by managing your details on our website or by advising us directly.

 

Please note that the information about our products on our publications (including the descriptions, quantities and price) does not represent an offer by us to sell the products on that basis. It is merely an invitation to you to make us an offer to purchase the relevant products on that basis. Accordingly, all references to "orders" placed by customers are deemed to be references to offers by such customers to purchase the relevant products from us.

 

A contract will only be formed upon our acceptance of your order. Acceptance is at our discretion and will depend, amongst other factors, upon the availability of the products ordered and the descriptions, quantities and of the products being those which we apply on the date of despatch of the products you have ordered.

 

Acceptance will be by electronic confirmation by us, or by taking steps to deliver the products you order.

 

Mixing or (de-mixing) of product scents and colours in cases is a limited chargeable service that is not available for online orders. Trade customers should contact the sales office sales@shearer-candles.com or call 0141 445 1066 if they wish to place an order for mixed cases.

 

PAYMENT

Payment Methods  Braintree  Worldpay

 

Payments can be made via bank or PayPal transfers, or by credit or debit card (at Shearer Candles' discretion), or via our secure online payment providers, Worldpay or Braintree. We accept Visa, Delta, Mastercard, Switch, Visa Electron and Solo.

 

Payment in full must be made prior to dispatch of the products by one of the methods detailed above unless you have an established credit line with The Company. If full payment for goods is not received, we reserve the right not to deliver the goods until all transactions are complete.

 

In the event of non-authorisation of card payment we will contact the card holder to advise. We are assured by our suppliers who provide the systems which we use for carrying out debit and credit card transactions, that transfer of information from the customer to us is conducted through secure channels using encryption facilities to prevent access by parties other than those involved in the trading transaction. We do not accept liability for any losses or costs incurred or sustained by customers and/or card holders who transmit such information.

 

Payment is due (if credit is given) net 30 days from date of Invoice.

 

All prices are subject to VAT unless the goods are for export. Exports to the E.U. will also be subject to VAT in the absence of a valid E.U. VAT number.

 

DELIVERY

 

Subject to stock availability, standard UK Mainland delivery will usually be made within three working days* of processing but may take up to 14 days.** International orders will be despatched within 2-3 working days* after you receive your order confirmation. All deliveries need to be signed for. If you miss your delivery, the courier will leave a telephone card in order for you to arrange another delivery date without incurring an extra charge. A next day delivery option is available at a surcharge of £20 for UK delivery orders placed before 11am.** Orders placed after 11.00am will be delivered using our normal service.

 

Deliveries outside the UK may incur additional charges such as local taxes for which you are responsible and payable by you. If you are not sure if extra charges are applicable to you, please contact us.

 

For all delivery addresses outside the UK you can opt for an Ex-works collection. We will then contact you with details of delivery and confirmation of delivery options, should you wish for Shearer Candles to deliver the order directly to you.

 

*Working days include Monday-Friday, 9am-5pm and exclude weekends and bank holidays.

Delivery prices are based on your order value excluding VAT.

 

*Subject to Availability. During December we do not offer a next working day delivery option - with weather and the amount of traffic we cannot guarantee this full service.

 

DAMAGED GOODS & SHORT/NON DELIVERY

 

Shearer Candles undergo a product quality check before orders are despatched. However, if you receive damaged goods, you must inform us via sales@shearer-candles.com, your Account Manager or by calling +44 (0)141 445 1066 within 3 days of delivery. When contacting us, please include your order reference number, your name and a description and product code of the damaged items. Photographic evidence of the damaged product(s) is required or credit will be refused. If you wish for a refund for damaged goods, you will be refunded the full amount including the original delivery charges. Do not accept goods with visible damages.

 

Short/Non-Delivery much be reported within 3 days of receiving your delivery. When contacting us, please include your order reference number, your name and a description and product code of missing items. We also may ask for you to complete a DOR Form (Denial of Receipt). If you wish for a refund for missing goods, you will be refunded the full amount including the original delivery charges.

We shall not be liable to pay any money to you by way of compensation, other than any refund.

 

REFUND POLICY

 

If, after we have accepted an order from you, you wish to withdraw from the contract then you may do so by informing us no later than 7 working days after the date of delivery of the products. If you notify us that you wish to cancel the order, we shall reimburse the payment made by you within 30 days of notification. If you notify us that you wish to cancel the order, and we have already delivered the product(s) to you, then you should return the product(s) to us at your own cost. If you do not return the product(s) to us and we are required to collect them from you we shall be entitled to recover our costs of doing so. Provided that the product(s) are returned in the same condition as when we supplied them to you, we shall reimburse all sums paid by you for those product(s) excluding any costs of delivery or any costs of recovery of the product(s) (where appropriate). No penalty will apply in such circumstances.

 

To obtain a refund, simply send us an email sales@shearer-candles.com or call us on +44 (0)141 445 1066, stating your order reference number, your name, the items you would like to return and the reason for refund. On approval, you are then responsible for sending back the goods clearly stating your order reference number and name. Once the goods have been received, the refund will be processed.

 

When returning items you are recommended to keep a proof of posting. Proof of posting will not be accepted as proof of delivery. We will not accept responsibility for lost or damaged parcels.

 

LIABILITY

 

You agree that you are at your own risk when using the Shearer Candles publications. We are not liable to any party in contract, tort or negligence for death, personal injury, damage, claim, loss, costs or expenses, specifically for:

 

  • Any special loss
  • Any economic loss including loss of revenue, profits, business or contracts
  • Any loss of data
  • Any loss of goodwill or reputation


WARRANTY

We make no warranty or guarantees regarding our products or information provided in our publications. In particular we do not guarantee:

 

  • Burn times - as these may vary in different environments
  • Burning instructions and tips - these are provided for guidance only. It is your responsibility that all candles are used safely. We will not accept responsibility for misuse.

 

The content of our publications is only for your general information and use and is not intended to address your particular requirements. In particular, the content does not constitute any form of advice, recommendation or arrangement by us and is not intended to be relied upon by users in making (or refraining from making) any decisions. Any arrangements made between you and any third party named on this Site are at your sole risk and responsibility.

 

SHEARER CANDLES WEBSITE

 

We will endeavour to make our site available 24 hours a day. However, we reserve the right to occasionally restrict access or make our website unavailable without notice. We cannot guarantee that the website will be faultless at all times. In such circumstances we will do our very best to solve the problem as soon as possible.

 

Our website contains links to other websites provided by independent third parties ("Third Party Sites"), either directly or through frames. Where possible, we will make clear where such links are being made. We are not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites.

 

We do not permit either of the following: Any other person sharing your Account Code and password; or Access through a single name and password being made available to multiple users on a network.

 

You are responsible for all use of our website made by you or anyone else using your username and password (collectively "ID") and for preventing unauthorised use of your ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID, please notify us immediately by emailing sales@shearer-candles.com.

TERMINATION

 

We reserve the right, at our sole discretion, to pursue all our legal remedies, including but not limited to deletion of your publications on any media and immediate termination of your registration with us and/or any other service provided to you by us, upon any breach by you of these Terms and Conditions or if we are unable to verify or authenticate any information you submit to us.

 

On termination you will be obliged to refrain from using any of our services.

Faulty Products much be reported within 3 days of complaint being raised. When contacting us, please include your order reference number, your name and a description and product code of faulty items. Photographic evidence of the damaged product(s) is required or credit will be refused. All faulty products must be returned to Shearer Candles before credit can be raised.

 

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

 

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

 

Failure by either party to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy. Headings in these Terms and Conditions are for convenience only and will have no legal meanings or effects.
